The Swiss Federal Law on Unfair Competition protects fair and undistorted competition in the interest of all participants, in particular competitors, in the free market.

Unfair competition is a remedy for border cases in the field of intellectual property; unfair competition completes the protection of intellectual property rights and delimitates the principle of the "freedom to imitate" ("Nachahmungsfreiheit").

Checklist:

• Does my product lean on the product of a competitor (me-too strategy)?
• Is there an intended reference to competitors (exploitation of reputation, damage of reputation, analogies, mitigation, copy of certain elements)?
• Are your products or actions misleading, in particular regarding goods, services, business relations or persons of competitors?
• Are you following a price leader strategy?
• Do you comply with specific regulations for certain goods or of certain (such as, in the field of advertising, the guidelines of the Fair Trading Commission)?
